1. Acceptance
By creating a page, paying for a plan or using the service, you declare that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the platform.
2. Account and eligibility
Use is permitted for users 18 years or older. Minors only with express consent of a legal guardian. You are responsible for all actions taken on your account. Loss of access due to negligence, device change or uninstallation does not create an obligation for exceptional support.
3. Services offered
Creation and hosting of customizable commemorative digital pages. All deliveries are digital. No physical products are shipped.
4. Plans
Começo Plan: free use for 24 consecutive hours for evaluation. História Plan: full access for 6 months. Eterno Plan: access for as long as the service is available online. This does not imply a promise of perpetuity.
5. Free pages
They expire automatically after 24 hours. Content may be removed without notice after expiration. Backup is the user's responsibility.
6. Service termination or changes
We may modify or discontinue the service for technical, legal or strategic reasons. For active plans (including Eterno Plan), in case of discontinuation, a minimum 30-day advance notice and export instructions will be sent, when applicable.
7. Payments
Payments are processed by authorized intermediaries (e.g. Mercado Pago). Activation occurs after payment confirmation by the processor. Prices may be updated at any time for new subscriptions.
8. Cancellations and refunds
Refunds follow Art. 49 of the Brazilian Consumer Defense Code. As the service is customized and digital, refunds are only possible within 7 days after payment and before definitive page activation.
9. User-submitted content
You are solely responsible for all content you submit. By publishing, you declare that you have the authorization and legality to use it. You grant a non-exclusive license to store and display the content within the platform, only for the provision of the service. The platform may analyze content automatically or manually for compliance verification.
10. Content rules (Important)
It is strictly prohibited to submit: any content involving minors, with or without nudity; explicit nudity, exposure of genitals or sexual acts; illegal, abusive, discriminatory content or that violates third-party rights. Suggestive/adult content is only allowed if all persons are clearly 18 or older and there is no explicit nudity. The platform may remove content or block pages at any time, without prior notice. If there is any indication or suspicion of content involving a minor, the page will be immediately blocked and authorities may be notified.
11. Unavailability and updates
The platform may be temporarily unavailable due to maintenance, technical failures or force majeure.
12. Limitation of liability
We are not liable for indirect damages, data loss or lost profits. Total liability is limited to the amount paid in the last 12 months by the user involved.
13. Copyright claims
Send your request to [email protected] with proof of ownership. Content may be preventively removed.
14. Communications
You authorize the sending of operational notices by email and/or WhatsApp.
15. Updates to these Terms
We may update these Terms periodically. Continued use after publication constitutes acceptance of the new version.
16. Governing law and jurisdiction
Governed by Brazilian law. The jurisdiction of Brotas/SP is elected.
